What injuries can
I claim for ? You are entitled to make a compensation
claim even if you have not sustained a serious injury. You are
entitled by law to be compensated for any injury arising out
of a non-fault accident. This can typically include cuts, bruises
and "soft tissue" injuries such as whiplash.
Is there a time
limit on submitting a claim for personal injuries ?
Yes. You have three years to make a compensation claim. In general
terms the sooner you make the claim the better. ie. as time
goes by your injuries may seem, when assessed, less severe and
you may receive a lower compensation cheque as a result.
Should I have reported
my injuries to my Doctor or hospital ? It is usually
beneficial to have visited your GP or hospital. This helps the
paperchase process. However if you have not been able to visit
a health professional it should not prevent us from presenting
a claim on your behalf.
Do we adhere to
the Solicitors Introduction & Referral Code 1990 and what
is it ? The Law Society, the solicitor's governing body,
permits solicitors to make agreements with their introducing
sources for referral work. Such agreements must comply with
a code, known as the Solicitors Introduction and Referral Code,
which contains strict rules to safeguard your interests as the
customer.
We comply with the Solicitors Introduction
and Referral Code published by the Law Society, and any solicitor
to whom we refer you is an independent professional, from whom
you will receive impartial and confidential advice.
With respect to our costs these are paid
by the solicitor and not via yourself.
How can a claim
cost me nothing ? We only appoint
solicitors who agree to enter into a Conditional Fee Agreement
in relation to their legal costs. They then take out an Insurance
Policy to protect you against any other potential costs.
With a successful claim the responsible third
party are required to pay ALL of your legal costs including
the cost of your insurance premium. In the unlikely event you
are unsuccessful in your claim the Insurance Policy will cover
all the legal costs.
In this manner the whole claim costs you
nothing, either way, and your rights are protected in law.
Who funds the insurance
and disbursements ? Your Appointed Solicitor provides
funding. You are not responsible for any funding costs.
Which
solicitor will negotiate my personal injuries claim ? In
the first instance your claim will be assessed by Pannone's.
We would expect this firm will work on your behalf however there
may be situations where we will need to point you in the direction
of another solicitor.
We will only do this if we feel this approach
will increase your chances of a successful claim.
Will I have to visit
the solicitor ? No, although you may visit the solicitor
if you wish.
The Appointed Solicitor will instruct an
Assessor who will arrange a confidential home visit.
